Welcome to Concert Calendar ("Concert Calendar," "we," "us," "our"), a social network for live music fans operated by Headwind Holdings LLC, a Texas limited liability company with a business contact address at privacy@concertcalendar.app.
These Terms of Service (the "Terms") govern your access to and use of the websites www.concertcalendar.app and my.concertcalendar.app, the Concert Calendar progressive web application, and any related services we offer (together, the "Service").
By creating an account, clicking "I agree," or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you may not use the Service.
You must be at least 16 years old to create an account or use the Service. By registering, you represent and warrant that you are 16 or older. If we learn that an account belongs to a user under 16, we will suspend and delete that account.
You represent that (a) you have the legal capacity to enter into these Terms, (b) you are not barred from receiving the Service under applicable laws, and (c) you will comply with these Terms and all applicable laws.
You must provide accurate and complete information when you register and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at privacy@concertcalendar.app if you suspect unauthorized access.
Concert Calendar lets you:
Concert Calendar does not sell tickets, process ticket purchases, or handle ticket transfers. Ticket section, row, and seat information you enter is informational metadata only.
The Service is currently provided free of charge. We may introduce paid features in the future and, if we do, we will notify you in advance; your use of any paid feature will be subject to additional terms you accept at that time.
We may add, modify, suspend, or remove any part of the Service at any time, with or without notice. We may also impose limits on certain features, restrict your access to parts or all of the Service, or decline to offer the Service in certain regions, without liability. Where reasonably practicable, we will give advance notice of changes that materially reduce functionality you rely on.
"User Content" means any content you submit — including photos, concert details, ratings, reviews, chat messages, bios, profile pictures, usernames, and any band/venue/festival entries you create.
You retain ownership of the User Content you post. We do not claim ownership of your photos, text, or ratings.
To operate the Service, you grant Concert Calendar a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, publish, publicly display, distribute, and otherwise use your User Content in connection with operating, providing, improving, and promoting the Service. This license lasts for as long as your User Content is on the Service and for a commercially reasonable period after removal.
Band, venue, and festival entries you add enter the shared knowledge base and may be used by other users. These records describe factual, public information and are not considered your personal content.
You represent and warrant that you own your User Content or have all rights needed to post it, that it does not infringe any third-party right, and that it does not violate any law or these Terms.
You agree not to use the Service for any of the following:
We may remove content, suspend, or permanently ban accounts that violate this policy.
Report violations using the in-app report button or email privacy@concertcalendar.app.
We respect intellectual-property rights and respond to valid DMCA notices. Send notices to privacy@concertcalendar.app. Counter-notices may be sent to the same address. We will terminate accounts of repeat infringers.
The Service, including its software, design, UI elements, logos, and trademarks, is owned by Concert Calendar and protected by copyright, trademark, and other laws. You may not copy, modify, reverse-engineer, or create derivative works of the Service.
The Service integrates with third-party services including MusicBrainz, Google Places, Resend, Google and Apple OAuth, and Web Push. We are not responsible for the content, policies, or practices of any third-party service.
You may delete your account at any time from settings. Your profile, photos, and attendance records are deleted. Chat messages may be anonymized to preserve thread context. Knowledge-base contributions are retained.
We may suspend or terminate your account if you violate these Terms, if required by law, or if your account poses a risk to others or the Service.
Request permanent deletion of residual content by emailing privacy@concertcalendar.app.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CONCERT CALENDAR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CONCERT CALENDAR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES. WE ARE NOT RESPONSIBLE FOR INTERACTIONS BETWEEN USERS, WHETHER ONLINE OR OFFLINE.
TO THE FULLEST EXTENT PERMITTED BY LAW, CONCERT CALENDAR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
You agree to indemnify and hold Concert Calendar harmless from any claim arising out of your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
These Terms are governed by the laws of the State of Texas, U.S.A.
Before filing any formal claim, you agree to contact us at privacy@concertcalendar.app and attempt to resolve the dispute informally for at least thirty (30) days.
Any dispute not resolved informally will be resolved by binding, individual arbitration administered by the AAA under its Consumer Arbitration Rules, in Dallas, Texas, U.S.A. You and Concert Calendar each waive the right to participate in a class action.
You may opt out of arbitration by emailing privacy@concertcalendar.app within thirty (30) days of first accepting these Terms.
We may modify these Terms from time to time. We will notify you of material changes at least thirty (30) days before they take effect. Continued use after the effective date constitutes acceptance.
